These Terms of Service ("Terms") govern your use of the DateCoach browser extension, website at https://datecoach.top ("Website"), and all related services (collectively, the "Service"). By using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using DateCoach. If you do not agree with any part of these Terms, you may not use our Service.

1. Description of DateCoach

DateCoach is an AI-powered browser extension that helps users improve their online dating success on Tinder, Bumble, and other dating platforms. Our Service provides:

2. Eligibility and Account Requirements

Age Requirement: You must be at least 18 years old to use DateCoach. By using our Service, you represent and warrant that you meet this age requirement.

Account Creation: To access certain features, you must create an account using Google OAuth or email authentication. You are responsible for maintaining the confidentiality of your account credentials.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3. Subscription Plans and Payments

Plan Options: DateCoach offers multiple subscription tiers (Free, Core, and Pro) with varying features and usage limits as described on our pricing page.

Pricing: Current pricing is $2.99/month for Core plan and $9.99/month for Pro plan. Prices are subject to change with notice.

Payment Processing: All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

Cancellation: You may cancel your subscription at any time through your account dashboard or Stripe's customer portal. Cancellation will take effect at the end of your current billing period.

No Partial Refunds: We do not offer prorated refunds for mid-cycle cancellations. You will retain access to paid features until the end of your billing period.

Refund Policy: We offer a 7-day money-back guarantee for first-time subscribers. To request a refund within this period, contact us at bartzalewskidev@gmail.com.

4. Acceptable Use Policy

You agree to use DateCoach responsibly and ethically. You may NOT:

- Use the Service to harass, abuse, or harm others
- Violate any dating platform's terms of service
- Attempt to reverse engineer, decompile, or extract the source code of our Service
- Use automated tools or bots to access the Service
- Share your account credentials with others
- Send spam or unsolicited messages using AI-generated content
- Use the Service for any illegal or unauthorized purpose
- Impersonate others or misrepresent your identity
- Scrape or collect data from the Service
- Use offensive, discriminatory, or hateful language in any interactions

We reserve the right to suspend or terminate accounts that violate these policies.

5. AI-Generated Content and User Responsibility

Suggestions Only: All AI-generated conversation starters, responses, and bio suggestions are recommendations only. You are solely responsible for reviewing, customizing, and deciding whether to use any AI-generated content.

No Guarantees: We do not guarantee specific results (e.g., number of matches, dates) from using our Service. Results vary based on many factors beyond our control.

Authenticity: We encourage you to personalize AI suggestions to reflect your genuine personality. The best results come from authentic communication.

Third-Party Platforms: You are responsible for complying with the terms of service of any dating platforms you use (Tinder, Bumble, etc.). DateCoach is not affiliated with these platforms.

6. Intellectual Property Rights

Ownership: DateCoach and all related trademarks, logos, and content are owned by us or our licensors. Our AI models, algorithms, and proprietary technology are protected by intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

User Content: You retain ownership of any content you provide to DateCoach. By using our Service, you grant us a limited license to process your data as described in our Privacy Policy.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

7. Privacy and Data Protection

OpenAI: We use OpenAI's API for AI generation. OpenAI's terms and policies apply to that service.

Stripe: Payment processing is handled by Stripe, subject to Stripe's terms.

No Warranties: We are not responsible for any issues arising from third-party services.

10. Disclaimers and Limitations of Liability

AS IS Basis: The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

No Results Guarantee: We do not guarantee that using DateCoach will result in specific outcomes such as more matches, dates, or relationships.

AI Limitations: AI-generated suggestions may occasionally be inappropriate, inaccurate, or ineffective. Always review content before using it.

Limitation of Liability: To the maximum extent permitted by law, DateCoach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Maximum Liability: Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless DateCoach and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any dating platform's terms of service

12. Termination

By You: You may terminate your account at any time by contacting us or canceling through your account settings.

By Us: We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violations of these Terms.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

Survival: Sections relating to intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

13. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of the United States, without regard to conflict of law principles.
